Railway, rolling stock registration

Registration of railways in the National Railway Traffic Register is governed by the Railway Act and Government Decree No. 74 "Establishment of the National Railway Traffic Register and Decree on Registry Management."

The registration of rolling stock in the National Railway Transport Register is governed by the Railway Act and Government Regulation No. 61 on the maintenance of the Railway Transport Register.

Railway registration

The aim is to register railways intended for public use and other railways connected directly or via other railways, including depots, to the public railways.

THE PROCESSOR OF THE REGISTER IS THE Consumer protection and technical regulatory authority.

Registration

  • The mandated processor shall verify the data transmitted to the Consumer Protection and Technical Regulatory Authority for the registration of a railway to ensure that all necessary information has been properly provided.
  • The data transmitter is the subject of a request for the correctness of the data, if the data is manifestly incorrect or if there is a conflict between the data transmitted and those previously entered in the register, or if a person has disputed the correctness of the data concerning him / her in the register. In the event of inconsistencies or incompleteness of the data, the data transmitter is obliged to provide the data processor with documents containing the correct data.
  • Upon receipt of duly transmitted data, the duly authorized processor issues a registration certificate to the railway owner or direct holder.
  • The registration certificate is issued by order of the Director General of the Consumer Protection and Technical Regulatory Authority;
  • The registration certificate is issued to the railway owner or the direct owner on the basis of a signature.
  • If the application for registration indicates several lines to be registered, the registration certificate for these lines will be issued jointly, i.e. a registration certificate will be issued.

State fee

Modification and correction of data in the register

  • In the event of a change in the data, the owner or direct holder of the railway shall transmit the new data in writing to the Consumer Protection and Technical Regulatory Authority.
  • A document confirming the payment of the state fee shall be attached to the application for amendment of the registration.
  • If incomplete or incorrect data is found in the Register, the Processor shall rectify it without delay or inform the data submitter, who is obliged to provide the correct data within the period set by the Processor. The Processor shall rectify incomplete or incorrect data without delay, but no later than five working days after receipt of the correct data.

Issuing data from the register

  • The data will be released on the basis of a written request from the Register specifying the data requested, the purpose for which it will be used and the person to whom it will be released.
  • The data will be made available free of charge and at the request of the applicant in paper or digital form.
  • The output of the register data is recorded in a digital notebook.
  • Access-restricted data will not be released from the register.

Registration of rolling stock

The aim is to register locomotives and wagons used for rail transport, as well as trains, road maintenance machinery and other machinery and mechanisms needed for transport.

THE PROCESSOR OF THE REGISTER IS THE consumer protection and technical regulatory authority.

It is forbidden to use railway vehicles that are not registered in an EU Member State. Railway undertakings operating in Estonia may use railway vehicles registered outside the EU Member States in accordance with international agreements for rail transport.

An unauthorized railway vehicle may only be used in the following cases:

  • for the purpose of transporting a railway vehicle entering the territory of the Republic of Estonia for the first time from the border to the destination;
  • for the purpose of testing the railway vehicle under the supervision of the Consumer Protection and Technical Regulatory Authority.

The registration of rolling stock in the Railway Traffic Register is regulated in Chapter 12 of the Railway Act and in the Ordinance No. 63 of the Minister of Economy and Infrastructure of 23.10.2020 "Basic Ordinance on Maintenance of the Railway Traffic Register."

A locomotive, a wagon, a train, a railway bus, a special vehicle and any other vehicle built for rail transport, whether powered or not, will be entered in the Railway Register.

The data in the Rail Traffic Register have an informative and statistical value. Unless otherwise provided for by law, their entry in the Rail Traffic Register has no legal consequences.

No registration number may be assigned to a vehicle in the register.

Transmission of data to the Rail Traffic Register

It is the owner or holder of the railway vehicle who transmits the data of the railway traffic register.

The deadlines for submitting the data to the Rail Transport Register are as follows:

  • data on rail vehicles not registered in the European Union will be transmitted before the vehicle is put into service on the territory of the Republic of Estonia;
  • In the event of changes to the rail vehicle data, the data must be transmitted within ten working days of the change.

In order to register a railway vehicle, the following documents must be submitted to the Consumer Protection and Technical Regulatory Authority:

  • a written application;
  • documents or copies thereof proving the acquisition of ownership or direct ownership of the rolling stock;
  • documents or copies thereof relating to the works of the manufacturer, the year of issue and the technical data of the technical passport or a copy thereof;
  • other documents or copies thereof certifying the conformity of the rail vehicle with the applicable requirements;
  • a copy of the authorization for commissioning issued in another Member State of the European Union;
  • for freight wagons, a list of wagons to be registered;
  • details of the payment of the state fee.

The person transmitting data to the Rail Transport Register is responsible for the accuracy of the data provided.

Registration

The Consumer Protection and Technical Regulatory Authority shall register the rolling stock in the Rail Transport Register within 30 days of submission of all necessary data and documents.

If the Consumer Protection and Technical Regulatory Authority finds that a railway vehicle does not meet the requirements, it refuses registration in the register of rolling stock.

At the request of the owner or holder of the railway vehicle, the Consumer Protection and Technical Regulatory Authority issues a certificate of approval for the railway vehicle entered in the Register of Rail Transport. The certificate of approval is issued for each unit of the approved railway vehicle. Issuing the certificate of approval is subject to payment of a state fee at the rate specified in the Act on State Levies.
